This Creator and Broadcaster Agreement applies in addition to the Terms of Service whenever you host, produce, record, or transmit content using Vizual Stems. If there is a conflict, the Terms of Service control unless this agreement is more protective of Vizual Live.
1. Your role
You are the producer and publisher of your broadcast. You control the content, participants, overlays, chat display, destinations, and recording settings. Vizual Stems provides tools, not editorial control, talent management, clearance services, or legal advice.
2. Rights and clearances
You represent that you own or have all necessary rights and permissions for everything in your broadcast, including:
- Music, sound recordings, compositions, and performance rights.
- Video clips, images, graphics, logos, and trademarks.
- Performances by artists, DJs, speakers, and guests.
- Venue, promoter, league, or organizer permissions.
- Any third-party content displayed on shared screens.
Vizual Stems does not obtain licenses for you and is not responsible for royalties, clearance fees, or union or guild obligations.
3. Guest notice and consent
Before recording or streaming, you must inform guests and participants that:
- The session may be recorded, streamed, transcribed, clipped, or redistributed.
- Their audio, video, name, likeness, and on-screen materials may be captured.
- The content may be published to third-party platforms.
You are responsible for obtaining consent that is legally sufficient in every applicable jurisdiction, including two-party consent jurisdictions.
4. Minors and vulnerable participants
If a broadcast includes a minor, you must obtain verifiable parental or guardian consent and comply with all applicable child protection laws. You may not use Vizual Stems to exploit, endanger, or sexualize a minor in any way.
5. Recordings and backups
Recordings may fail, be interrupted, or be incomplete for reasons including network conditions, browser behavior, device performance, and third-party outages. You are responsible for downloading and independently backing up recordings you need. Storage provided with a plan is operational storage, not an archival guarantee.
6. Destinations and third-party platforms
You are responsible for maintaining authorized destination accounts and complying with each platform's terms and community standards. Vizual Stems cannot guarantee that a destination will accept, publish, retain, monetize, or continue to display a broadcast, and is not responsible for strikes, takedowns, demonetization, or account actions taken by a third-party platform.
7. Advertising, sponsorship, and monetization
You are responsible for complying with advertising, endorsement, disclosure, sweepstakes, gambling, alcohol, and consumer-protection laws applicable to sponsorships or promotions you run in your broadcast, including required disclosures. Vizual Stems does not collect, hold, or distribute creator revenue, ticket sales, or viewer payments through this Service.
8. Conduct and moderation
You must comply with the Acceptable Use Policy. You are responsible for moderating your own chat, guests, and on-screen content. Vizual Stems may remove content, end a session, or restrict access when reasonably necessary to enforce our policies, respond to legal process, or prevent harm.
9. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Vizual Stems from third-party claims arising from your broadcast, your User Content, your failure to obtain rights or consents, or your violation of law or these policies, as further described in the Terms of Service.
